Welcome to RosenArt. This document outlines the terms and conditions governing your use of our website and the purchase of our unique paintings. We invite you to read these conditions carefully before making any purchase or interacting with our platform.

1. Purpose

These General Terms and Conditions of Sale (GTCS) govern the sales of handmade paintings offered on the RosenArt website.

2. Seller Identity

3. Products

The artworks offered are original creations, entirely painted by hand. Each piece is unique and may show slight variations, which are part of its artistic character and do not constitute a defect.

4. Price

The prices of the artworks are indicated in euros (€) Net of Tax (HT). VAT not applicable, article 293 B of the French General Tax Code (CGI). For deliveries outside the European Union and in the French Overseas Territories: Prices are exclusive of customs duties and local VAT. The customer is considered the importer of the artwork. Customs duties, local taxes (import VAT), or postal/carrier handling fees may be required upon arrival of the package. These costs are the exclusive responsibility of the buyer, both in terms of declarations and payments to the competent authorities of their country. It is the buyer's responsibility to inquire about these costs with their local customs authorities before placing an order.

5. Order

Any order implies full and unreserved acceptance of these GTCS. A confirmation is sent after payment validation.

6. Payment

Payment is secure and is made via the methods offered on the site (credit card, PayPal, etc.).

7. Shipping and Delivery

Artworks are shipped to the delivery address provided by the customer when ordering, after payment validation. Shipping costs: Delivery fees are calculated and displayed when validating the cart, before final payment. Deadlines and carrier: Shipments are made via La Poste (Colissimo) or any other carrier selected by RosenArt. Delivery times are given for information purposes only. RosenArt cannot be held responsible for delivery delays attributable to carriers or customs holds. Packaging and insurance: Each painting is carefully packaged with appropriate protective materials. Shipments benefit from transport insurance covering the value of the artwork in the event of proven loss or damage during transport. Customs procedures and package refusal: If a package is blocked in customs, returned to the sender, or refused by the buyer due to refusal to pay customs duties or local VAT, the return fees applied by the carrier as well as the original shipping costs will remain the exclusive responsibility of the buyer and will be deducted from any potential refund.

8. Reception and Verification

The customer is required to check the condition of the package upon receipt. In case of damage, the customer must:

  • make reservations with the carrier

  • contact RosenArt within 48 hours with supporting photos Without reservations or proof, RosenArt’s liability cannot be engaged.

9. Right of Withdrawal and Returns

In accordance with Article L.221-18 of the French Consumer Code, the customer has a period of 14 clear days from receipt of their order to exercise their right of withdrawal, without having to justify reasons or pay penalties. Exceptions: The right of withdrawal does not apply to artworks made to specific order or clearly personalized at the customer's request. Return conditions: Return costs are the exclusive responsibility of the customer. The artwork must be returned in its original condition, perfectly packaged in its original packaging or equivalent packaging guaranteeing its protection. The customer is responsible for the return shipment and must subscribe to transport insurance covering the value of the artwork. Any product damaged upon return cannot be refunded.

10. Refund

In case of accepted return:

  • a refund or replacement may be offered

  • the artwork must be returned in its original condition RosenArt reserves the right to refuse a refund if the conditions are not met.

11. Liability

RosenArt’s liability is limited to the value of the order. Once the artwork is delivered and accepted, RosenArt cannot be held responsible for:

  • damage related to improper handling or unsuited hanging

  • failure to comply with instructions for care and conservation of the artwork

  • exposure to extreme environmental conditions (humidity, direct and prolonged exposure to sunlight, heat sources)

  • natural wear and tear of the artwork over time All orders are shipped via La Poste France, UPS, CHRONOPOST, with careful and secure packaging adapted to the artworks. Each shipment benefits from transport insurance corresponding to the value of the artwork. In case of damage observed during transport and confirmed by the carrier (damaged package, delivery incident, etc.), a claim procedure will be carried out with La Poste. The customer can then benefit from compensation or a refund according to the terms of the transport insurance.

12. Certificate of Authenticity

Each artwork is accompanied by a unique certificate of authenticity, guaranteeing its origin and original character.

13. Intellectual Property

All artworks, images, and content present on the site are protected by copyright. Any reproduction or use is prohibited without authorization.

14. Force Majeure

RosenArt cannot be held responsible for failure to perform or delay in performing its obligations in case of force majeure or events beyond its control (natural disaster, strike, transport breakdown, war, interruption of postal services, etc.).

15. Consumer Mediation

In accordance with Articles L.611-1 and following of the French Consumer Code, the customer may have free recourse to a consumer mediator with a view to the amicable resolution of a dispute. A consumer mediator will be communicated to the customer upon joining an approved organization.

16. Applicable Law and Disputes

These GTCS are subject to French law. In case of dispute, the parties will primarily seek an amicable solution before any legal action.
